What is understood by Spaniards who are not by origin?

Non-origin Spaniards are people born abroad from a Spanish father and mother, those born in Spain from foreign parents when one of them was born in Spain; those born in Spain from foreign parents when both lack nationality or the nationality of neither of them attributes a nationality to the child, as well as those born in Spain whose filiation is not determined. All of them may be deprived of the Spanish nationality acquired under the terms indicated in the Civil Code.

 

In this way, Article 25 states that you can lose your Spanish nationality as a penalty when:

Spaniards who are not Spaniards by origin shall lose their nationality:

 

  1. When during a period of three years they use exclusively the nationality they had declared to renounce when acquiring Spanish nationality.
  2. When they voluntarily enter into armed service or hold political office in a foreign State against the express prohibition of the Government.
  3. When a final judgement declares that the person concerned has been guilty of falsehood, concealment or fraud in the acquisition of Spanish nationality. However, no detrimental effects shall be derived therefrom for third parties in good faith. The action for annulment must be brought by the Public Prosecutor’s Office either ex officio or by virtue of a complaint, within a period of fifteen years.

 

Consequently, the loss of Spanish nationality is produced by the use of the renounced nationality, by entering the military service or public position against the prohibition of the Government, or by a sentence that declares to have incurred in falsehood, concealment or fraud in the acquisition of Spanish nationality.
