CLAIM SHEET IN SPAIN

The claims sheets in Spain are four self-copying sheets, which are each a different colour, white, green, yellow and pink. Each colour corresponds to one of the following four languages, Spanish, Valencian, English and French.

The Spanish claim sheets are kept by the following parties as described below:

– The original white colour must be sent by the consumer to the Territorial Services of Commerce and Consumption (Servicios Territoriales de Comercio y Consumo in Spanish).

– The green copy remains with the claimant consumer.

– Two copies, the yellow and pink ones, are kept by the establishment.

In Spain, these claim sheets must be provided to any consumers who request them, immediately and free of charge, even if they have not already established a commercial agreement with the establishment, which is to say regardless of whether or not services or a good has been exchanged.

In order to get these claim sheets, it is necessary to pay the required fee, and then, the owner of an establishment can pick them up from the town hall located in the town where the property is located.

Kindly note that to be able to receive the claim sheets, it is necessary to present proof of payment of the taxes to the proper authorities.

Therefore, when a consumer requests a claim sheet, the one provided should match the location from where it has been requested. The consumer should not be referred to other agencies or to a distant central office in order to obtain a claim sheet.

 

INFORMATIONAL POSTER ABOUT CONSUMER CLAIMS SHEET

Any company or individual owner of an establishment or apartments that are obliged to hand out a consumer complaint sheet must make the sheets available to whomever requests them. The owner is also obliged to inform the public that the claim sheets are available by posting the following sign in a perfectly visible location:

The poster should be located in a spot in the establishment or apartment where it is clearly visible to the public and able to be read. The size of the letters in the sign must be at least one centimetre in size and be written in the two official languages of the Comunidad Valenciana, which are Valencian and Spanish.

 

SANCTIONS REGARDING THE CLAIMS SHEETS IN SPAIN

Infringements for breach of the obligations regarding the consumer claims sheets will be sanctioned according to LAW 1/2011, of March 22, of the Generalitat, “Comunidad Valenciana”, approving the Statute of the Consumers and Users of the Valencian Community.

  1. The infractions will be sanctioned with either a warning or fines in accordance with the basic state regulations:
  2. a) Minor infractions will be given either a warning or imposed a fine of any amount not to exceed 3,005.06 Euros. A sanction which consists of only a warning may be imposed, only once, for a formal complaint of non-compliance or a disregard for the simple indications of the administrative authority. However, they must be subsequently corrected immediately based on the findings of the investigation on file.
  3. b) More serious infractions will be fined between 3,005.07 and 15,025.30 Euros.
  4. c) Very serious infractions will be fined between 15,025.31 and 601,012.10 Euros.
