Welex is your multilingual law firm in Spain, and below, we detail the nine requirements you should have when choosing a short-term rental apartment in Valencia.

1- The registration number assigned to each property and its category should be included in any form of publicity/ advertisement.
Kindly note that if a management company is handling the apartment, which is different from the others that are in the same building, it is sufficient to publicize the registration number of the management company.
The tourist apartments in Spain and specifically in the Valencia area that are registered should exhibit, in a visible location in their entrance, an indication of their condition as a tourist apartment, including its category and its registration number.
2- It is not possible to rent only one room or several rooms of an apartment to a tourist; the owner cannot be living in the apartment if they wish to rent it. The property should only be rented as a unit.
3- Spanish property in Valencia should be in perfect habitable condition in accordance with its category.
4- The property should have adequate conditions of conservation, cleaning and provision of services starting on the day chosen to begin the rental; all promised supplies and facilities should be in operational order.
5- The publicity, the offer and the management of tourist properties will adjust to the exigencies of veracity, objectivity and good faith, which requires the renter to provide the client or user sufficient information about the characteristics and the conditions of use and the benefits that comprise the contracted services.
6- The tourist apartments should be classified in one of the following categories: superior, first and standard.
It is expected that the facilities and services of tourist apartments should be maintained, at all times, in accordance with the conditions, requirements and determining qualities of its classification and category.
7- According to the Spanish law “Decreto 19/1997, 11th February, del Consell,” all tourist apartments have the obligation to provide their customers with an invoice detailing, in a clear and delineated manner, the services provided organized by concepts.
The tourist apartment owners will be obliged to keep duplicates of the invoices for verification by the competent authorities.
The invoices should clearly state next to the name of the establishment/apartment, the name of the client, the number or identification of the assigned accommodation, the number of people housed, the date of entry and exit and the date on which the rental agreement was extended if applicable.
8- The owners or management companies of tourist apartments may request a deposit of any amount that, unless otherwise agreed upon, will not exceed 250 Euros.
This deposit will also increase in direct relation to the number of occupants. In the event that the rental property is in fact occupied by more people than allowed, the owner can adjust the price accordingly or alternatively end the contract.
In accordance with what was agreed upon in the contract and at the end of the contract, once the rental agreement has ended, the deposit will be refunded to the client prior to any possible deductions that may be applicable.
9- According to the Law 3/1998, of May 21, of the Generalitat Valenciana on Tourism of the Comunidad Valenciana, the fines for a breach of the contract could range anywhere between 600€ to 90.000€ depending on the severity of the breach.
